What happened
Plaintiff Luis Borquez filed this lawsuit in the Los Angeles County Superior Court against Oxford Hotels and Resorts, LLC, doing business as The Godfrey Hotel Hollywood. The suit alleges California labor law violations, including unpaid overtime and minimum wages, missed meal periods and rest breaks, unreimbursed business expenses, and inaccurate itemized wage statements, along with an unfair competition claim under Business and Professions Code section 17200 and a claim for civil penalties under the Private Attorneys General Act (PAGA).
Oxford denies the allegations and says it complied with all applicable laws, and the Court has not decided who is right. The settlement is a compromise reached to avoid the cost, risk, and delay of continued litigation, and Oxford does not admit any wrongdoing.
How to file a claim
-
1. Confirm you are a Class Member
If you were a non-exempt employee of Oxford in California between November 10, 2018 and July 20, 2025, you are likely a Class Member. The Notice mailed to you shows your credited Workweeks and PAGA Pay Periods on its first page. If you are unsure, call Simpluris at (833) 386-6560.
-
2. Understand how your share is calculated
Your Individual Class Payment equals the Net Settlement divided by the total Workweeks of all Participating Class Members, multiplied by your Workweeks. Aggrieved Employees also receive a share of the $7,500 PAGA pool based on PAGA Pay Periods. For tax purposes, 20% of each Individual Class Payment is treated as wages and 80% as interest and penalties.
-
3. No claim form: keep your address current
There is no claim form. Payments are mailed automatically to the address on file, so notify the Administrator right away if you move. You can contact Simpluris at (833) 386-6560, info@1400CahuengaSettlement.com, or by mail at P.O. Box 26170, Santa Ana, CA 92799. The FAQs and case documents are posted at 1400CahuengaSettlement.com.
-
4. Receive your payment
Oxford must fund the settlement no more than 28 days after the Judgment becomes final, and checks are mailed after that. Participating Class Members receive one check covering their Individual Class Payment and any Individual PAGA Payment. Each check shows a void date, and uncashed checks are sent to the California Controller's Unclaimed Property Fund.

Where the money is going
Oxford agreed to pay a Gross Settlement of $675,000. Court-approved attorneys' fees, litigation expenses, the Class Representative Service Award, administration costs, and PAGA penalties are deducted first. The remaining Net Settlement is divided among Participating Class Members based on Workweeks, with no claim form required.
All amounts listed above are pending and subject to final court approval. The Court may award less than the amounts requested. The Net Settlement figure is our own estimate using the maximum requested deductions and is not stated by the Administrator. The $7,500 PAGA share for Aggrieved Employees is paid separately from the Net Settlement.
Common questions
How much money will I receive?
Individual amounts are not fixed. Each Participating Class Member receives a share of the Net Settlement (estimated at about $363,000 if all requested deductions are approved) based on the number of Workweeks worked during the Class Period. Aggrieved Employees also receive a share of the $7,500 PAGA pool based on PAGA Pay Periods.
Do I need to submit proof of purchase?
No proof or claim form is needed. Workweeks and PAGA Pay Periods come from Oxford's records. The deadline to challenge your credited numbers with supporting records was July 31, 2026.
What if I didn’t receive a notice?
Class Members were identified from Oxford's records and notices were mailed to the addresses on file. If you think you qualify but did not get a notice, contact Simpluris at (833) 386-6560 or info@1400CahuengaSettlement.com and confirm your mailing address.
Does staying in the class affect my right to sue later?
Participating Class Members release wage and hour claims for the Class Period based on the facts alleged, including overtime, minimum wage, meal and rest period, wage statement, reporting time pay, business expense, and unfair competition claims. All Aggrieved Employees, including those who opted out, release PAGA penalty claims for the PAGA Period. Claims such as wrongful termination, FEHA, and workers' compensation are not released.
When will payments be sent out?
Payments are mailed after the Judgment becomes final and Oxford funds the settlement, which must happen no more than 28 days after finality. Objections or an appeal can delay that timeline. Check the settlement website for updates.
