What happened

Plaintiff Mary Teofilo filed this class action against C-Plant Federal Credit Union in the McCracken Circuit Court in Kentucky. The lawsuit alleges that C-Plant improperly charged overdraft fees on signature-based debit card transactions that were authorized when the account had sufficient funds and later settled in the same authorized amount.

C-Plant denies that the fees were improper and denies any wrongdoing, and the Court has not decided who is right. The parties settled after mediation to avoid the cost, risk, and delay of continued litigation. Under the Settlement Agreement, no money reverts to C-Plant: leftover funds go to a second distribution or, if too small, to Kentucky Civil Legal Aid and the United Way of Paducah-McCracken County.

How to file a claim

  • 1. Confirm you are a Class Member

If you received a postcard or email notice about Teofilo v. C-Plant Federal Credit Union, C-Plant's records show you paid at least one Challenged Fee between July 14, 2013 and August 25, 2025. If you are unsure, call 1-888-808-7177.

  • 2. Understand your payment

Your share is pro rata: your Challenged Fees divided by all Challenged Fees paid by the class, multiplied by the Net Settlement Fund. You will not receive more than the fees you paid and will likely receive less. Payments are made by check.

  • 3. Keep your mailing address current

Common questions

How much money will I receive?

Payments are pro rata, based on the Challenged Fees you paid compared with the total paid by all Class Members, from the Net Settlement Fund of the $1,050,000 settlement. You will not receive more than the fees you paid and will likely receive less.

Do I need to submit proof of purchase?

No proof or claim form is needed. C-Plant's records identify Class Members and the Challenged Fees each paid, and the Settlement Administrator calculates payments.

What if I didn’t receive a notice?

Class Members were identified from C-Plant's records and sent a postcard or email notice. If you think you paid a Challenged Fee but did not get a notice, or you have moved, call 1-888-808-7177 so the Administrator can check the class list and your address.

Does staying in the class affect my right to sue later?

Because the exclusion deadline has passed, Class Members release C-Plant and related parties from claims relating to the Challenged Fees charged during the Class Period. The release does not cover bodily injury claims or claims under the Servicemembers Civil Relief Act.

When will payments be sent out?

The Court granted final approval on August 31, 2026. Under the Settlement Agreement, checks are mailed 35 days after the Effective Date, which is generally 30 days after final approval if there is no appeal. Checks can be cashed for 120 days.
