What happened
This lawsuit, Butler v. Case Foods, Inc., claims that Case Foods failed to protect personal information in a targeted cyberattack on its computer systems in October 2024. Cybercriminals gained access to files on the company's network that may have included names, Social Security numbers, financial account information, and driver's license numbers. The case is pending in the North Carolina Superior Court for Iredell County.
Case Foods denies that it did anything wrong, and the Court has not decided who is right. The parties agreed to settle to avoid the cost and risk of continued litigation.

Common questions
How much money will I receive?
You can claim reimbursement of up to $2,000 for documented, unreimbursed losses caused by the breach, such as credit freeze fees, card replacement fees, late fees, bank fees, postage, and up to one year of credit monitoring bought after October 1, 2024. Or you can choose a flat $45 Alternative Cash Payment. Anyone who files a valid claim can also get two years of one-bureau credit monitoring.
Do I need to submit proof of purchase?
The $45 Alternative Cash Payment requires no proof, only a Claim Form. Documented loss claims require receipts or other records not prepared by you; self-prepared documents alone are not enough.
What if I didn’t receive a notice?
The Class is made up of people Case Foods notified about the October 2024 breach. If you believe you were affected but did not receive a notice, get more information from the settlement website directly at CFISettlement.com or call (866) 675-2749.
Does staying in the class affect my right to sue later?
Yes. Unless you exclude yourself by December 18, 2026, you cannot sue Case Foods separately over the issues this settlement covers. The released claims are described in Section 6 of the Settlement Agreement.
When will payments be sent out?
Payments are distributed only after the Court grants final approval and any appeals are resolved. The Final Approval Hearing is January 11, 2027. Check CFISettlement.com for updates.
