CPAP Medical Supplies Data Breach Class Action Settlement

CPAP Medical Supplies and Services, Inc. agreed to settle a class action over a December 2024 cyberattack that allegedly exposed names, Social Security numbers, health insurance information, medical histories, and financial information. Class members can claim reimbursement of up to $5,000 in documented losses, and all class members are eligible for two years of CyEx Medical Shield Complete monitoring.   • Excluded: Anyone who opts out of the settlement by the October 30, 2026 deadline.

What happened

The lawsuit concerns a December 2024 cyberattack on CPAP Medical Supplies and Services, Inc., a medical supply company. The plaintiffs allege the attack compromised private information including names, physical and email addresses, telephone numbers, Social Security numbers, driver's license numbers, health insurance information, medical histories, treatment plans, and financial information.

CPAP Medical Supplies and Services denies any wrongdoing, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. Documented loss claims are paid from a claims-made cap of $500,000 payable by the Defendant, and payments are reduced pro rata if valid claims exceed that cap.

How to file a claim

  • 1. Confirm you are eligible

    You qualify if you are a living individual residing in the United States and CPAP Medical Supplies and Services sent you a notice that your Private Information may have been impacted in the Data Incident. If you are unsure, call the Settlement Administrator at (833) 285-3011.

  • 2. Choose your benefits

    Two benefits are available. Cash Payment for Documented Losses reimburses up to $5,000 per person for out-of-pocket losses such as identity theft or fraud losses, credit monitoring fees, ID replacement costs, and postage incurred between December 13, 2024 and November 26, 2026. Medical Data Monitoring provides two years of CyEx Medical Shield Complete, including $1 million of medical identity theft insurance.

  • 3. File online or by mail

    Submit the Claim Form online at the official claim portal by November 26, 2026, or download a paper Claim Form and send it with any supporting documentation by email or U.S. mail to CPAP Data Incident Settlement, P.O. Box 25226, Santa Ana, CA 92799-9958. The online form asks for the LoginID and PIN printed on your notice. If you cannot find them, email info@CPAPDataIncidentSettlement.com with your full name and mailing address. Documented loss claims require receipts, bank statements, or similar records, and personal notes alone are not enough. The Long Form Notice and Claim Form are posted at CPAPDataIncidentSettlement.com.

  • 4. Receive your benefits

    Payments and monitoring enrollment are provided after the Court grants final approval at the December 1, 2026 Final Approval Hearing and any appeals are resolved. No follow-up is required once your claim is submitted.

The Final Approval Hearing is scheduled for Tuesday, December 1, 2026 at 8:30 a.m. ET and will be held via Zoom. The Court will also consider Class Counsel's request for $400,000 in attorneys' fees and costs and service awards of $1,000 per class representative. Opt-out requests and objections are due by October 30, 2026. The Court may move the hearing, so check CPAPDataIncidentSettlement.com for updates.

Where the money is going

This is a claims-made settlement, not a common fund. CPAP Medical Supplies and Services will pay valid documented loss claims up to an aggregate cap of $500,000. If valid claims exceed the cap, payments are reduced pro rata. Two years of medical data monitoring is available to all class members. Attorneys' fees and service awards are requested separately.

All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. Documented loss payments may be reduced pro rata if valid claims exceed the $500,000 cap.

Common questions

How much money will I receive?

Class members can claim reimbursement of up to $5,000 for documented out-of-pocket losses, and all class members are eligible for two years of CyEx Medical Shield Complete medical data monitoring with $1 million of medical identity theft insurance. Loss payments come from a $500,000 cap and may be reduced pro rata if claims exceed it.

Do I need to submit proof of purchase?

Yes, for cash. Documented loss claims require supporting records such as receipts or bank statements, and personal notes alone are not sufficient. Medical data monitoring does not require proof of loss, but you still need to follow the Claim Form instructions to enroll.

What if I didn’t receive a notice?

The class is limited to people who were sent notice by CPAP Medical Supplies and Services. The online Claim Form asks for a LoginID and PIN from that notice. If you cannot find them, email info@CPAPDataIncidentSettlement.com with your full name and mailing address, or call (833) 285-3011 before the November 26, 2026 deadline.

Does staying in the class affect my right to sue later?

If you stay in the settlement, you release all claims against CPAP Medical Supplies and Services and the other Released Parties relating to the Data Incident, whether or not you file a claim. To keep your right to sue, you must opt out by October 30, 2026.

When will payments be sent out?

Benefits are distributed after the Court grants final approval at the December 1, 2026 Final Approval Hearing and after any appeals are resolved. An appeal can add a year or more to that timeline.
