What happened
This lawsuit, Doe, et al. v. Prime Healthcare Services, Inc., et al., claims that Prime Healthcare and several of its hospitals used tracking technologies, including the Meta Pixel and Google Analytics, on their websites and patient portals, and that these tools sent patients' health information to third parties without consent in violation of California privacy and medical confidentiality laws and the federal Electronic Communications Privacy Act. Claims from a related federal case, R.S. v. Prime Healthcare, were folded into this case, which is pending in Los Angeles County Superior Court.
Prime Healthcare denies any wrongdoing, including that the tracking tools operated inside password-protected patient portals, and the Court has not decided who is right. As part of the settlement, Prime agrees not to use Google Analytics or the Meta Pixel on covered websites for five years after final approval, except under business associate agreements, and to audit its websites annually.

Where the money is going
This settlement does not use a common fund. Prime Healthcare pays a fixed $20 to each Patient Portal Subclass member who files a valid claim, provides one-year medical identity monitoring codes, and separately pays attorneys' fees and costs, service awards, and administration costs. Class members are paid in full and those separate amounts do not reduce the $20 payment.
Fees, service awards, and administration costs are requested or estimated amounts and remain subject to Court approval at the March 9, 2027 Final Approval Hearing. The Court may award less than requested.
Common questions
How much money will I receive?
Patient Portal Subclass members who file a valid claim receive a one-time $20 cash payment. The amount is fixed and is not reduced pro rata. Covered class members also receive a one-year medical identity monitoring code.
Do I need to submit proof of purchase?
No receipts are required. Online claims use the Class Member ID on your notice, and you attest that you used a covered patient portal. The Settlement Administrator checks claims against Prime's records. Get claim instructions from the settlement website directly.
What if I didn’t receive a notice?
If you believe you fit the class definition but did not receive a notice, get more information from the settlement website directly at PHSettlement.com or call the Settlement Administrator at (833) 319-5511.
Does staying in the class affect my right to sue later?
Yes. Unless you exclude yourself by December 21, 2026, you will be bound by the settlement and give up the right to sue the Defendants over the claims released in the Settlement Agreement, whether or not you file a claim. Members of neither subclass are still bound but do not receive cash or a monitoring code.
When will payments be sent out?
The Final Approval Hearing is March 9, 2027. Payments are due after the settlement becomes effective, following final approval and any appeals. Check PHSettlement.com for updates.
