What happened
This lawsuit, Jose A. Morales Rosario, et al. v. Hospital Español Auxilio Mutuo de Puerto Rico, Inc., claims that Auxilio Mutuo Hospital in San Juan, Puerto Rico failed to adequately protect patients' personal information that may have been accessed or acquired by an unauthorized party in a cybersecurity incident that began in September 2023. The case is pending in the United States District Court for the District of Puerto Rico.
Auxilio Mutuo Hospital denies that it did anything wrong, and the Court has not decided who is right. The parties agreed to settle the case to avoid the costs, risks, and uncertainty of continued litigation. The hospital has also adopted measures to strengthen its data security.

Common questions
How much money will I receive?
You can claim up to $2,500 for documented out-of-pocket losses, or a $25 alternative cash payment, but not both. Two years of credit and medical monitoring is also available. Payments may be reduced pro rata to stay within the $500,000 cap.
Do I need to submit proof of purchase?
The $25 alternative cash payment requires no documentation. Documented losses require receipts or other third-party documents; self-prepared documents such as handwritten receipts are not enough on their own.
What if I didn’t receive a notice?
If you believe your information was involved in the incident but did not receive a notice, get more information from the settlement website directly at HospitalEspanolAuxilioSettlement.com or call (833) 453-0919.
Does staying in the class affect my right to sue later?
Yes. Unless you exclude yourself by December 21, 2026, you will be bound by the Settlement and give up the right to sue Auxilio Mutuo Hospital and the Released Parties over the claims resolved in this case, whether or not you file a claim. The full release is in the Settlement Agreement, available on the settlement website.
When will payments be sent out?
The Court will hold the Final Approval Hearing on January 20, 2027. Payments are made only after the Court grants final approval and any appeals are resolved. Check HospitalEspanolAuxilioSettlement.com for updates.
