What happened

Plaintiffs Charlie Stacy and Clifford Allen sued Jennmar Corporation of Virginia, Inc. and related defendants in the U.S. District Court for the Western District of Virginia. They allege that Defendants failed to pay non-exempt hourly employees at their manufacturing facilities for all compensable time, including certain pre-shift and post-shift work, because of their timekeeping practices, in violation of the Fair Labor Standards Act and Virginia law.

Defendants deny liability, and the Court has not decided who is right on the merits. The parties agreed to settle to avoid the cost, risk, and delay of trial. The Court entered a Final Approval Order and Judgment on August 26, 2026. Uncashed checks will not revert to Defendants and, subject to Court approval, go to the Southwest Virginia Legal Aid Society.
