What happened
This lawsuit, Kingsbury, et al. v. Evernorth Health Inc., et al., claims that Evernorth Health, Inc. and MDLIVE, Inc. violated the Florida Security of Communications Act (Fla. Stat. § 934.03) and the federal Electronic Communications Privacy Act (18 U.S.C. § 2511) by disclosing users' sensitive information from the MDLIVE patient portal to Google and Meta without consent through website tracking technologies. The case is pending in the Circuit Court for the Thirteenth Judicial Circuit in Hillsborough County, Florida, and the Class Representatives are Kelly Kingsbury and Erin Yates.
The Defendants deny that they did anything wrong, and the Court has not decided who is right. The parties agreed to settle the case to avoid the costs, risks, and uncertainty of continued litigation.

Common questions
How much money will I receive?
Each eligible claimant may receive one cash payment of up to $15.00. The final amount depends on the number of approved claims and the amounts the Court awards for fees, costs, and service awards, and payments may be reduced pro rata. There is only one payment per class member.
Do I need to submit proof of purchase?
No receipts or records are required. You must attest, under penalty of perjury, that you are an MDLIVE user who signed in to and used the patient portal between May 30, 2023 and August 11, 2025, and that you had an active Facebook and/or Google account during that period. Third-party reports indicate the online form asks for the Claimant ID printed on your notice.
What if I didn’t receive a notice?
Notices went to MDLIVE users identified in the Defendants' records. If you believe you fit the class definition but did not receive a notice, get more information from the settlement website directly at EHISettlement.com or call the Settlement Administrator at (833) 453-3739.
Does staying in the class affect my right to sue later?
Yes. Unless you exclude yourself by November 16, 2026, you will be bound by the Settlement and give up the right to sue the Defendants and related parties over the claims resolved in this case, whether or not you file a claim. The full release is in Sections 1.24 through 1.26 and 3.1 through 3.2 of the Settlement Agreement, available at EHISettlement.com.
When will payments be sent out?
The Court will hold the Final Approval Hearing on January 6, 2027. Payments are made only after the Court grants final approval and any appeals are resolved, which can take a year or more. Check EHISettlement.com for updates.
