What happened
Former SkinSpirit employee Sarah Rad filed this lawsuit on October 9, 2024 in Alameda County Superior Court. The complaint alleges SkinSpirit failed to provide meal and rest periods or pay premiums for them, failed to pay minimum, overtime, and contractual wages, issued inaccurate wage statements, failed to pay all wages due at separation, failed to reimburse necessary business expenses, and failed to provide employment records. It also seeks civil penalties under California's Private Attorneys General Act (PAGA).
SkinSpirit denies the allegations and any liability, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. The Court granted final approval of the settlement on September 9, 2026. According to the settlement website, payments are not yet ready to be issued.
How to file a claim
-
1. Confirm you are a Class Member
You are a Class Member if you worked for SkinSpirit in California as a non-exempt employee at any time from October 9, 2020 through March 1, 2026. Notices were sent to Class Members identified in SkinSpirit's records. If you are unsure, call Atticus Administration at (800) 658-9129.
-
2. Understand how your payment is calculated
The Net Settlement Amount is divided by the total workweeks worked by all Participating Class Members, and each person receives a share based on their own workweeks. Aggrieved Employees also receive a share of the $11,750 Individual PAGA Payment pool based on pay periods worked from June 6, 2023 through April 15, 2026. For tax purposes, 20% of each Individual Class Payment is treated as wages (reported on a W-2) and 80% as non-wage amounts (reported on a 1099).
-
3. No claim form: keep your address current
You do not need to file a claim. Checks are mailed to the address the Administrator has on file, so if you have moved, update your mailing address with Atticus Administration through the settlement website contact page, by calling (800) 658-9129, by emailing ssesettlement@atticusadmin.com, or by writing to Rad v SkinSpirit Essential, c/o Atticus Administration, PO Box 64053, St. Paul, MN 55164. The notice, settlement agreement, and court orders are posted at SkinSpiritEssentialSettlement.com.
-
4. Receive your payment
Under the settlement agreement, SkinSpirit funds the settlement within 30 days after the Judgment becomes final, and the Administrator mails checks within 14 days after funding. As of October 2026, the settlement website says payments are not yet ready to be issued and asks class members to check back for the distribution schedule. Checks are void at least 180 days after mailing, and uncashed funds go to Legal Aid at Work.

Where the money is going
SkinSpirit agreed to pay a $490,000 non-reversionary Gross Settlement Amount. Court-approved attorneys' fees, litigation costs, the class representative service award, administration costs, and PAGA penalties are deducted first, and the remaining Net Settlement Amount is paid to Participating Class Members based on workweeks. About 200 Class Members are covered. Money from checks not cashed by the void date goes to Legal Aid at Work as the cy pres recipient.
All amounts listed above are pending and subject to final court approval; the Court granted final approval on September 9, 2026, and the final awarded amounts may be lower than the maximums requested. The estimated Net Settlement Amount is our own arithmetic assuming every requested deduction was approved in full. Individual payments depend on workweeks and pay periods worked.

Participating Class Members release wage and hour claims based on facts during the Class Period, including unpaid minimum, overtime, and contractual wages, meal and rest period claims, wage statement and final pay claims, expense reimbursement under Labor Code section 2802, and related unfair competition claims.
