- You purchased any Tom's of Maine toothpaste product between November 21, 2020 and March 6, 2026
- You purchased the product for personal or household use, not for resale
- No proof of purchase is required (but having receipts may increase your refund)
- Excluded: Tom's of Maine, Inc. and Colgate-Palmolive Company, their officers, directors, employees, and agents; the Judge and Court staff; and anyone who timely opts out.

What happened
In May 2024, the U.S. Food and Drug Administration conducted an inspection of the Tom's of Maine manufacturing facility in Sanford, Maine, and identified concerns about whether the company was following Current Good Manufacturing Practices. The Defendants subsequently reviewed approximately 4,900 finished toothpaste products manufactured over a three-year period and reported finding no safety risk. Multiple class action lawsuits were filed alleging that Tom's of Maine, Inc. and its parent company Colgate-Palmolive Company engaged in deceptive and misleading business practices related to their toothpaste products.
The lawsuits were consolidated in the U.S. District Court for the Eastern District of New York (Rabinowitz et al. v. Colgate Palmolive Company et al., Case No. 2:25-cv-06996). The Defendants deny all allegations and deny any wrongdoing or liability. The Court has not determined that the Defendants did anything wrong. The parties agreed to a $2,900,000 settlement to avoid the risks, costs, and delays of continued litigation. Class members can receive a refund for up to one product per household without proof of purchase, or a full refund for up to three products with proof of purchase.

You qualify if you purchased any Tom's of Maine toothpaste product between November 21, 2020 and March 6, 2026 for personal or household use anywhere in the United States. You do not need proof of purchase, but having receipts may increase the amount you receive.

Choose your claim type
Without proof of purchase: you can claim the average manufacturer's suggested retail price for up to one product per household. With proof of purchase (such as a receipt, loyalty card record, or bank statement): you can claim a full refund for up to three products. All payments are subject to pro rata adjustment based on total valid claims.

Where your money goes
If total valid claims exceed the net settlement fund, payments will be reduced pro rata. If claims are lower than expected, individual payments may increase. Any remaining funds after distribution will be donated to Equal Justice Works as a cy pres recipient.

How much money will I receive?
Without proof of purchase, you can receive the average manufacturer's suggested retail price for up to one product per household. With proof of purchase, you can receive a full refund for up to three products. All amounts are subject to pro rata adjustment depending on how many valid claims are filed. If fewer claims are submitted, individual payments may be higher than the baseline amounts.
Do I need proof of purchase?
No. You can file a claim without any proof of purchase and receive the average MSRP for one product. However, if you have receipts, loyalty card records, bank statements, or other documentation showing your purchase, you may receive a full refund for up to three products. Submitting proof of purchase increases the amount you can claim.
Was there anything actually wrong with the toothpaste?
The FDA inspection identified concerns about Current Good Manufacturing Practices at the Tom's of Maine facility in Sanford, Maine. The Defendants reviewed approximately 4,900 finished toothpaste products and reported that no safety risk was identified. The Defendants deny all allegations in the lawsuit and deny any wrongdoing. The Court has not made any determination that the Defendants did anything wrong. The settlement resolves the litigation without any admission of liability.
Does staying in the class affect my right to sue later?
Yes. If you remain in the Settlement Class, you will release your claims against Tom's of Maine, Colgate-Palmolive, and related parties concerning the allegations in this case. To preserve your right to sue independently, you must submit a written exclusion request postmarked by July 6, 2026. Exclusion requests should be mailed to the Settlement Administrator at PO Box 2897, Portland, OR 97208-2897.
When will payments be sent out?
The Court is scheduled to hold a Final Approval Hearing on September 10, 2026 at 11:00 a.m. ET in Central Islip, NY. Payments will be distributed after the settlement is approved and becomes final.
