What happened
The lawsuit concerns a targeted cyberattack between March 22 and March 26, 2024 at Chimienti & Associates, a managed general agency that provides employer-paid benefit solutions and management services. According to the settlement website, files that may have been accessed contained names, Social Security numbers, dates of birth, state-issued identification such as driver's license numbers, financial account information, and health information. Plaintiffs allege Chimienti failed to adequately protect this information.
Chimienti denies any wrongdoing, and the Court has not decided who is right. The parties agreed to settle to avoid the cost, risk, and delay of continued litigation. The $650,000 non-reversionary settlement fund pays class member benefits as well as notice and administration costs, any service awards, and attorneys' fees and litigation costs.

1. Confirm you are eligible
You qualify if you are a living individual residing in the United States whose Private Information was impacted in the March 2024 Chimienti Data Incident. If you are unsure, call the Settlement Administrator at (833) 421-7301.

2. Choose your benefits
Choose either Cash Payment A, reimbursement of up to $5,000 for documented losses such as identity theft or fraud losses, credit report and credit monitoring fees, ID replacement costs, and postage incurred from March 22, 2024 onward, or Cash Payment B, a pro rata cash payment of up to $100 that requires no documentation. Every class member who files can also claim two years of CyEx Financial Shield Complete credit monitoring with $1 million in financial fraud insurance. All benefits are subject to the $650,000 fund and may be reduced pro rata.

3. File online or by mail
Submit your claim online at the official claim portal by December 28, 2026, or mail a paper Claim Form postmarked by that date to Chimienti Data Incident Settlement, c/o Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799-9958. The online form requires the LoginID and PIN printed on your notice; if you do not have them, email info@ChimientiDataSettlement.com with your full name and mailing address. Documented loss claims require supporting documentation. The notice and claim form are posted at ChimientiDataSettlement.com.

4. Receive your benefits
Payments are scheduled to be distributed within 45 days after the settlement becomes final, which happens after the Court grants final approval at the January 12, 2027 Final Approval Hearing and any appeals are resolved. Payments are made electronically or by paper check, and you will have 60 days to select an electronic payment or cash a check.

The Final Approval Hearing is scheduled for January 12, 2027 at 8:30 a.m. PT in Department 02 of the Superior Court of California, County of Tulare, 640 South Alta Avenue, Dinuba, CA 93618. The Court will also consider Class Counsel's request for attorneys' fees, costs, and service awards, which are paid from the settlement fund. Opt-out requests must be postmarked, and objections filed with the Court, by December 14, 2026. The Court may move the hearing, so check ChimientiDataSettlement.com for updates before traveling.
Where the money is going
Chimienti will pay $650,000 into a non-reversionary settlement fund. The fund covers documented loss reimbursements, cash payments, and credit monitoring for class members who submit valid claims, plus notice and administration costs, any service awards, and attorneys' fees and litigation costs. Because Cash Payment B is adjusted pro rata, the final amount per claimant depends on how many valid claims are filed. Any money left over is directed to the Electronic Privacy Information Center or another court-approved nonprofit.
All amounts listed above are pending and subject to final court approval at the Final Approval Hearing. The Court may award less than the amounts requested. The Cash Payment B amount of up to $100 is subject to pro rata adjustment based on the number of valid claims and the funds remaining after deductions.

Do I need to submit proof of purchase?
Cash Payment A for documented losses requires supporting documentation. Cash Payment B does not require documentation, but you still need to submit a valid Claim Form. The online form requires the LoginID and PIN from your notice.
What if I didn’t receive a notice?
The class includes living individuals residing in the United States whose Private Information was impacted in the Data Incident, and filing online requires the LoginID and PIN printed on the notice. If you think you should have received one, email info@ChimientiDataSettlement.com with your full name and mailing address, or call (833) 421-7301, before the December 28, 2026 deadline.
Does staying in the class affect my right to sue later?
If you stay in the settlement, you release claims against Chimienti arising from the Data Incident, including negligence, breach of contract, California privacy, and unfair competition claims, whether or not you file a claim. To keep those rights, you must opt out with a request postmarked by December 14, 2026.
When will payments be sent out?
