  • Your personal information or protected health information (including dates of birth, Social Security numbers, medical information, health insurance information, or driver's license numbers) was potentially compromised between February 11, 2022 and February 14, 2022

  • Excluded: governmental entities, the Judge assigned to the Action, the Judge's immediate family, and Court staff.

What happened

Between February 11 and February 14, 2022, Henderson & Walton Women's Center, P.C. experienced a cybersecurity incident in which an unauthorized party accessed its computer systems containing personal information of current and former patients. On February 29, 2024, plaintiff Kim Townsel filed a class action complaint in the Circuit Court of Jefferson County, Alabama, asserting claims for negligence, negligence per se, breach of implied contract, breach of fiduciary duty, and unjust enrichment (Kim Townsel v. Henderson & Walton Women's Center, P.C., Case No. CV-2024-900914.00).

Henderson denies any wrongdoing and the Court has not decided who is right. To avoid the cost and risk of further litigation, the parties agreed to a settlement that offers class members three years of credit and medical identity monitoring, reimbursement for documented ordinary losses up to $150, compensation for documented extraordinary losses up to $2,500, and up to $90 for lost time spent dealing with the incident.

    Confirm you received a notice

    Class members were mailed direct notice with a Notice ID. If you are not sure you qualify, call the Settlement Administrator toll-free at 1 (855) 823-4243 or email info@HWWCDataIncidentSettlement.com.

    Choose your benefits

    You may select any combination of: three years of medical and credit monitoring (no documentation needed); reimbursement for ordinary losses up to $150 (with receipts or third-party documentation); compensation for extraordinary losses up to $2,500 (with supporting documentation such as identity theft reports or financial records); and up to $90 for lost time ($30 per hour, up to 3 hours, with an attestation). Ordinary losses include out-of-pocket expenses and credit monitoring products purchased between August 2022 and August 27, 2026.

    Receive your benefits

    If approved, credit and medical monitoring activation instructions will be emailed after the Settlement becomes Final. Cash payments will be issued by the payment method you select on the Claim Form, after the August 12, 2026 final approval hearing and any appeals.

Final approval hearing will be held at the Jefferson County Courthouse, 716 Richard Arrington, Jr. Blvd. N., Birmingham, AL 35203. Note that the claim deadline (August 27, 2026) falls after the final approval hearing. Check the settlement website for any updates. Payments follow after final approval and any appeals.

This is a claims-made settlement. Benefits are paid out of Defendant's funds based on valid claims submitted, rather than from a fixed common fund. Attorneys' fees, costs, and the service award are paid separately from class member benefits.

All amounts listed above are pending and subject to final court approval at the fairness hearing.

What benefits can I claim?

Class members may claim any combination of: three years of medical and credit monitoring at no cost (no documentation required); reimbursement for ordinary losses up to $150 with supporting documentation (out-of-pocket expenses, postage, gas for local travel, and fees for credit reports or credit monitoring purchased between August 2022 and August 27, 2026); compensation for extraordinary losses up to $2,500 with supporting documentation (e.g., identity theft reports, police reports, or out-of-pocket expenses not otherwise reimbursed); and up to $90 for lost time ($30 per hour for up to 3 hours) with an attestation describing the activities performed.

What documentation do I need?

Claims for medical and credit monitoring and for lost time do not require documentation. Ordinary loss claims must be supported by receipts or other non-self-prepared documentation. Extraordinary loss claims may be supported by identity theft reports, affidavits, police reports, correspondence with financial institutions, or evidence of out-of-pocket expenses not otherwise reimbursed. You cannot claim expenses already reimbursed by another source.

Does filing a claim affect my right to sue HWWC later?

Yes. By staying in the Settlement Class (including by filing a claim or doing nothing), you release your claims against Henderson & Walton Women's Center and other Released Parties relating to the Cybersecurity Incident. To preserve your right to sue on those claims, you must exclude yourself by mailing a signed opt-out request postmarked by July 13, 2026 to HWWC Settlement, Attn: Opt-Out Requests, P.O. Box 58220, Philadelphia, PA 19102.

When will payments be sent out?

The Court will hold a Final Approval Hearing on August 12, 2026. Payments and monitoring activation will only be issued after the Settlement is approved and becomes Final, including after any appeals are resolved. Check hwwcdataincidentsettlement.com for updates.
